DA drops charges against San Quentin inmate

The Marin County District Attorney’s Office plans to drop criminal charges against an inmate at San Quentin State Prison for possession of a weapon by an inmate.

In April 2019, the DA’s Office filed charges against Cary (CJ) Smith based upon reports submitted to the DA by the California State Department of Corrections. The case was continued on several occasions for additional investigation to be conducted by the DA’s Office and the Marin County Public Defender’s Office. The COVID-19 pandemic resulted in additional delays.

Based upon the additional investigation, DA Lori E. Frugoli determined that the charges against Smith should and will be dismissed in the interest of justice. 

Frugoli said no additional information or statements regarding the case will be made at this time.
